1. Contract
These terms and conditions shall represent a legally binding contract between the Client and Mayfair Maternity. The verbal or written instruction by the Client to the Agency to submit suitable Candidates for contact or interview shall constitute acceptance by the Client of there terms and conditions. The Candidate is the person introduced by the Agency. The agreed terms and conditions are non negotiable.
2. Fees
(i). Fees are payable by the client to Mayfair Maternity (The Agency) upon the offer of employment, either verbally or in writing by the Client to the Agency. It is the responsibility of the Client to notify the Agency if a Candidate has been offered employment. Fees are payable to Mayfair Maternity within 14 days of receipt of invoice. All bookings are deemed as unconfirmed until Agency fees are paid in full and late payment will incur a 10% surcharge for each week or part thereof. The fees quoted are per week or part thereof. Fees are always paid to the Agency prior to the commencement date.
(ii). The Client will notify the Agency if a temporary Candidate continues after the contract term. An additional fee will be applicable. If the Client re-employs a Candidate within 24 months, the standard fees will apply. This may be subject to a price increase.
(iii). The fee to the Agency and to the Candidate is based on the number of weeks initially requested as agreed. No refund or reduction by the Agency will be given if the number of weeks is reduced by the Client. If the temporary period is extended then paragraph (ii). will apply.
3. Third Parties
Clients transferring names, telephone numbers, addresses, e-mail contact of Candidates obtain through Mayfair Maternity to other people or companies will be held liable for fees due from resulting engagements. The terms in paragraph 2 (i) will apply. This will apply in any capacity whether the Candidate is paid or unpaid by the third party. All information given by the agency to the Client shall remain confidential and must not be passed on.
4. Liability
Mayfair Maternity endeavors to provide the Client with only the most suitable Candidate. References will be checked before employment commences. Clients are strongly advised to take up their own references to their own satisfaction. After engagement has been concluded the Agency cannot be held responsible for any loss or damage of whatever nature arising directly or indirectly for any act of omission of any Candidate introduced by the Agency even if such an act or omission is negligent, fraudulent or reveals any dishonesty. This will also apply for a clash of personalities between the Client and the Candidate or for any other circumstances that may arise and which should be resolved between the Client and the Candidate. The Candidates are not employed by the Agency
5. Cancellations, Refunds and Payment
(I). To book a Maternity Nurse, Consultant or Advisor, a deposit will be required and paid directly to the Candidate at interview which will be non-refundable. Contracts of employment are agreed between the Client and Candidate and should be confirmed in writing between the two parties. In the event of your baby being overdue, the Candidate should be retained at the agreed weekly salary from the original date of her booking to secure her services. Where a birth occurs before the booked date and the Candidate is unable to fulfill either all or part of the placement und the Agency is unable to offer a replacement, no refund will be made.
(ii). Should a Candidate fail to take up her employment, the Agency reserves the right to offer a suitable replacement. If this is not possible the full agency fee will be refunded.
(iii). Should the Client cancel the services of a Maternity Nurse less than 30 days before the agreed start date, the Client will be requested to pay the Maternity Nurse the first week’s salary in conjunction with any deposit mode which will be non-refundable. The Agency will retain the full booking fee paid.
(iv). Ito cancellation is made for a Sleep or feed Consultant less than 14 days before the agreed start date, 50% of the agreed total hours/days booked will be paid to the Consultant. The deposit paid to the Consultant will also be non-refundable. The Agency fee will be charged at all times if a verbal or written agreement is made between the Client and the Agency or the Consultant.
(v). If the Client cancels during the course of the booking no refund will be made and the Client will be required to pay the Candidate all monies owed for each day worked plus 1 weeks salary in addition, against loss of earnings.
6. Additional Terms.
The Client is responsible for the Candidate’s traveling expenses, parking fees and congestion charges at the beginning and at the end of the booking and is to be agreed directly with the Candidate (inland revenue guidelines 40p per mile). This is also applicable for the Candidate attending for interview. The Client will be advised of the location the Candidate is traveling from.
7. Telephone Consultations
Telephone consultations are either a 45 minute period or a series of 30 minute consultations, usually over 2 weeks. The time of call is pre-booked at a convenient time for both parties. If the client is unavailable at the time of the pre-booked call one re-schedule can be agreed at no further cost. No refunds will apply to booked telephone consultations whatsoever. In the event of the Client being unable to retain a composed manner, the Consultant will terminate the conversation and the Client will forfeit fees paid or payable.
8. E-mail Consultations
E-mail consultations are for 8 individual questions. No refunds will apply whatsoever.
These terms and conditions are governed by the law of England and Wales and are subject to exclusive jurisdiction of the Courts of England and Wales.
These terms and conditions can be amended by the Agency without prior notice. The Agency reserves the right to decline registration without explanation.
